DAHIL sa kawalan ng sapat na merito,ibinasura ng Department of Justice(DoJ) ang kasong graft, conspiracy at falsification of public documents na isinampa ng Panay Electric Company(PECO) laban sa mga kritiko nito na kinabibilangan ng mga abogado at advocates na syang nasa likod ng ‘No to PECO Franchise Renewal.” Sa resolution na ipinalabas ng DoJ na sinulat ni Prosecutor General Benedicto Malcontento, sinabi nito na walang basehan ang kasong isinampa ng PECO laban kina Atty. The senator revealed that the overpayment of PhilHealth reimbursements was obvious in the cases of medical facilities in Mindanao, such as Olegario General Hospital in Misamis Oriental and Eastern Sun Medical Center in Zamboanga. The former received P38.2 million in reimbursements despite cases amounting to only P5 million, while the latter was reimbursed P24.9 million for cases totaling only P4.7 million.

It was also granted a business permit by the Iloilo City government and Certificate of Public Convenience and Necessity (CPCN) from the Energy Regulatory Commission (ERC) but PECO continues to question the takeover of its business operations saying it was unconstitutional.
