THE SENATE can overturn, change or amend any bill that the House of Representatives will submit to the Senate in connection with the ABS-CBN franchise.
Thus said former Senate President Juan Ponce Enrile as he warned that giving provisional franchise might not be compliant to the Constitution.
"You can amend, alter and substitute, that is your power. Power of origination belongs to the HOR, once it releases the bill it loses control and it goes into the hands of the Senate then you can do anything with that bill," Enrile explained as he answered questions raised by Senator Panfilo Lacson during the Senate Committee on Public Services hearing on ABS-CBN franchise.
"What you’re saying is if we agree with the HOR in granting ABS-CBN a provisional franchise, we could also face constitutional challenge later on? But if we amend 6732 and grant ABS-CBN a permanent legislative franchise then it’s perfectly okay?" Lacson further said .
"That’s perfectly okay. I’m sure SC will sustain that." Enrile answered.
Enrile also said insisted that instead of a provisional franchise, Congress must decide on the permanent franchise.
"Alam mo Mr. Committee Chairman, di ko maintindihan ano ba ang urgency ng prangkisa na ibibigay sa ABS-CBN, tapos na ang termino nila, negosyo dapat ihinto. Ngayon, ang urgency ba nyan kailangan malaman ng ating mga kababayan ang nangyayari sa ating bansa?," Enrile added.
"My God, the nooks and corners of this Republic is rich, not by television but by radio. Our people know whats going on all over the country because of radio. More than ABS-CBN and GMA 7 or tv or the government stations and all the other tv stations, so the question of communication and information is not an issue," he added.
"The issue here is we must comply with the constitution. We must comply with the laws. We must follow the rule of the law in the coming years. Wag naman parang nilalaro ang saligang batas natin," Enrile further said.
